Bills that passed the 2009 Legislature

House Bill 1935 - Adult Family Homes in Homeowner Associations.

The original bill would have required HOAs to amend their governing documents to remove any reference of prohibiting Adult Family Homes to operate, or persons with disabilities to live in the HOA. More importantly, the legislation would have voided all such restrictive covenants that have the effect of directly or indirectly limiting the ability of people with disabilities to live in the residence of their choice, including Adult Family Homes. An Adult Family Home is defined as a non-profit or for-profit business that provides housing, personal care, special care, and room and board to more than one but not more than six disabled, elderly, or vulnerable adults who are not related by blood or marriage to the person or persons providing the services to the disabled.
