ADU, AFFECTS ON ASSOCIATIONS
With ADUs impacting how community associations look and function, it is critical that communities get ahead of the changes.

Accessory Dwelling Units (ADUs) have gained momentum as a partial solution to the affordable housing crisis.  The Washington Legislature recently passed laws that encourage ADUs and strip away barriers to their construction and use. This presentation will provide an overview of Washington’s evolving ADU laws and the policies behind the legislative push.  We will discuss what is now required and prohibited, and address the impacts of ADUs on community associations formed before and after the laws took effect.  With ADUs impacting how community associations look and function, it is critical that communities get ahead of the changes.

Tony Rafel, Esq, CCAL, is a Fellow in the College of Community Association Lawyers (CCAL), a Past President of WSCAI, and a current member of WSCAI’s ADR and Legislative Action Committees. Tony has been practicing community Association law in Seattle for over 35 years.  His practice includes construction defect litigation, insurance recovery litigation, covenant and rule enforcement, and boundary, view and nuisance cases.  Tony also serves as general counsel to boards, advising on governing document interpretation and amendment, governance best practices, current legal requirements, problem solving, and dispute resolution.  Tony has been peer-selected as a Washington SuperLawyer™ every year since 2001 and holds the top peer-review rating for legal skill and ethical standards from Martindale-Hubbell.  In addition to his service with WSCAI, Tony is a co-chair of the CCAL Law Seminar Planning Committee and a member of the CAI Amicus Curiae Committee.  Tony is also a past president of the Federal Bar Association of the Western District of Washington and lawyer representative to the Ninth Circuit Judicial Conference.  Tony practices with VF Law in downtown Seattle.
